Terms and Conditions

These are the general terms and conditions of the sound manufacturer LautHolz, hereinafter also referred to as LautHolz, which apply to the purchase of loudspeakers and accessories.
1. CONCLUSION OF CONTRACT
1.1 The contractual partner is Klangmanufaktur LautHolz, located at Alfons-Auer-Straße 8e in 93053 Regensburg, represented by Ulrich Decker.

1.2. The content of our website constitutes only a non-binding invitation to submit a contractual offer. You can submit a binding contractual offer by email to info@lautholz.com or via our contact form. The purchase contract is only concluded upon a reply email from LautHolz, in which we declare acceptance of the offer.
1.3. The contract language is German. If you order in English via the email address info@lautholz.com or via the contact form on our English-language website www.lautholz.com, the contract language is English.
1.4 Order Process
1.4.1 Speakers
In order for you to submit a binding purchase offer to us, we must create a custom quote in the Speakers section.
For speakers, you are responsible for the shipping costs. Since our speakers can only be shipped by freight forwarder due to their size and weight, shipping costs must be calculated individually.

- You submit a non-binding inquiry via one of our contact options.
- We send you a non-binding quote by email.
- You submit your binding purchase offer in writing by mail or email.
- You receive our approval by sending us the contract confirmation by email. This concludes the purchase contract.
We are personally available by phone to answer any questions you may have throughout the entire process.
1.4.2 Accessories
Since there are no shipping costs for you in the Accessories section, you can submit a binding purchase offer directly via one of our contact options. Please ensure that you describe the desired item precisely, including all options. The Terms and Conditions, which are always available HERE and in the download area, are deemed to have been read and accepted.
The process in detail

- We accept your purchase offer by sending the contract confirmation by email. This concludes the purchase contract.
- OPTIONAL: For custom-made products (e.g., a non-standard cable length), we will provide you with a non-binding offer in advance by email. You can use this offer to send us a binding purchase offer.
- OPTIONAL: If you would like a non-binding offer first, we can provide one before step one.
We are personally available by phone to answer any questions you may have throughout the entire process.
2. PRICES & SHIPPING COSTS
The prices displayed on our website include VAT at the currently applicable statutory rate. The prices listed on our website are in euros.
Delivery costs are already included in the Accessories section within Germany. Different delivery costs for delivery addresses outside Germany will be listed separately during the ordering process. Delivery costs in the Speakers section are not included. These are determined based on the product, size, weight, and destination and will be shown during the purchase contract process.
Other additional costs that may be borne by you will be stated before the contract is concluded. For deliveries to countries outside the European Union, various fees and taxes may apply, including customs duties and import sales tax. These costs cannot be shown in advance and are the sole responsibility of the buyer.
3. PAYMENT AND DELIVERY
3.1 The following payment methods are available:
- PayPal
- Sofortüberweisung (see www.sofort.com)
- Purchase on account (bank transfer)
3.2 For loudspeakers, half of the purchase price is due upon your order. The remaining purchase price is due upon receipt of our notification that your loudspeakers are ready for production. We will send you a payment request for each order. For all other products, the full purchase price is due upon your order.
3.3 Delivery within and outside Germany is carried out by DHL Parcel and freight forwarding. We deliver to addresses in the following countries: Germany, Belgium, Denmark, France, Italy, Liechtenstein, Luxembourg, the Netherlands, Norway, Austria, Portugal, Sweden, Switzerland, and Spain.
3.4 Our products are only manufactured specifically for you after you place your order. Therefore, the delivery time is approximately 3-4 weeks from the time of your order and receipt of payment. Specified delivery times are not to be understood as an offer to conclude a fixed transaction with a guaranteed delivery date. Any deviating delivery times are stated in the respective product descriptions.
4. RESERVATION OF TITLE
The goods remain the property of Klangmanufaktur LautHolz until full payment has been made.
5. RIGHT OF WITHDRAWAL
5.1 You have the right to withdraw from the purchase contract within fourteen days without giving any reason. The withdrawal period expires fourteen days after the day on which you physically take possession of the goods.
To exercise your right of withdrawal, you must notify us of your decision to withdraw from the contract by means of an unambiguous declaration (e.g., a letter sent by post or an email). This notification can be sent by post to

You may use the sample withdrawal form, but you are not required to do so. To comply with the withdrawal period, it is sufficient that you send your notification of the exercise of the right of withdrawal before the expiry of the withdrawal period. You must return or hand over the goods to

without undue delay and in any event no later than fourteen days after you notify us of your decision to cancel this contract. This deadline will be deemed met if you send the goods before the expiry of the fourteen-day period.

5.2 Effects of Cancellation
If you cancel this contract, we will refund all payments we have received from you promptly and in any event no later than thirty days from the date on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless another means of payment was expressly agreed with you. Under no circumstances will you be charged any fees for this refund. We may defer repayment until we have received the goods back or until you have provided proof that you have sent the goods, whichever is earlier.
The cost of returning the goods is borne by the customer, except in the case of a product exchange. Please contact us to arrange for the return shipment. For goods that can be sent via DHL parcel, you can arrange the return shipment yourself.
You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary to check their quality, properties, and functioning.
5.3 Exceptions to Cancellation
There are statutory exceptions to the right of cancellation (Section 312g of the German Civil Code (BGB)). We reserve the right to invoke the following provision against you:
A right of cancellation does not apply to contracts for the delivery of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive. This also includes products that are clearly tailored to the personal needs of the consumer.
We will expressly inform you about the products exempt from the right of withdrawal during the conclusion of the purchase contract.
6. TRANSFER OF RISK
The risk of deterioration or loss of the goods passes to you when you take possession of the delivered goods or when the goods are handed over to a carrier commissioned by you, which is not one of the carriers offered on our website.
7. WARRANTY, GUARANTEE
7.1 We are liable for any defects in the loudspeakers we supply in accordance with statutory provisions.
7.2 In addition to the statutory warranty, we provide a manufacturer’s warranty on our products subject to the following provisions:
Warranty Period
We provide a 3-year warranty on our surface modifications (e.g., anodizing, coating, painting). The warranty period for our cables and the technical function of the loudspeakers is 5 years from the date of purchase. Your invoice serves as proof of warranty.
Scope of Warranty Claim
The warranty applies to defects in materials and workmanship, as well as technical defects. The warranty applies to consumers (Section 13 of the German Civil Code (BGB). The warranty applies to all parts and labor costs from the date of delivery. It includes and is limited to a free repair or replacement of the defective part in the event of a material defect in the goods (e.g., material or manufacturing defects). The Klangmanufaktur LautHolz will also cover the shipping costs for the affected product, from or to the curb, in the case of a legitimate warranty claim, provided the goods are located within Germany, Austria, and Switzerland and the shipment was previously coordinated with LautHolz. Additional goodwill arrangements are possible at LautHolz’s discretion. During the manufacturer’s warranty period, it is presumed that the material defect already existed at the time of transfer of risk. Replaced parts become the property of LautHolz. Services provided under the manufacturer’s warranty neither extend the warranty period nor initiate a new warranty period. The warranty period for installed spare parts ends with the warranty period for the entire device. The promise or performance of warranty services is made without acknowledgment of any obligation to perform under statutory warranty law.
Loss of Warranty Claim
The manufacturer’s warranty is void in the event of improper mechanical impact on the product, in particular on the housing, attachments, or speaker chassis, e.g., due to improper mechanical impacts on the product, in particular on the housing, attachments, or speaker chassis, e.g. This warranty also applies to cases of dented dust caps or domes, damage from drops, and scratches occurring after delivery.
It also becomes void in the event of improper operation or handling of the speakers, e.g., with defective or unsuitable amplifiers, improper connection, or exposure to amplifier power exceeding their rated power. Any attempt at repair by the customer, improper operating environment, improper storage (e.g., damage due to moisture), improper transport packaging, especially if the speaker is not in the original packaging, or improper transport, will void the manufacturer’s warranty. The instructions in the user manual must be observed.

7.4 Your statutory warranty rights remain unaffected by this warranty.
8. ACCEPTANCE OF OUR TERMS AND CONDITIONS
Before entering into a contract with us, you must read the Terms and Conditions. During the contract conclusion process, we will provide you with the Terms and Conditions in writing. The PDF can be saved or printed. Upon receipt of the Terms and Conditions during the contract conclusion process, they are deemed to have been delivered and accepted by you.
The validity of the general terms and conditions of the contractual partner is hereby rejected.
9. DISPUTE RESOLUTION
LautHolz points out that the European Commission provides a platform for online dispute resolution at https://consumer-redress.ec.europa.eu/index_de. LautHolz is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
10. NOTICE ACCORDING TO THE ELECTRICAL ELEMENTS ACT
The “crossed-out wheeled bin” symbol means that an electrical or electronic device must not be disposed of with household waste at the end of its service life. It must be disposed of separately. This can be done at free collection points for old electrical devices in your area. Your city or municipal administration will provide you with the addresses of these collection points. As the end user, you are legally obligated to return electrical devices or dispose of them properly.
Please remove any batteries or rechargeable batteries – if possible – before disposal and dispose of them separately at the appropriate collection points.
We, as a retailer, are also obligated to take back old devices as follows:
If you have purchased speakers or cables offered on this website from us, you have the option of having an old device of the same type, which essentially performs the same functions as the new device, collected by us free of charge upon delivery of the new device (“old for new”).
